Duomenų subjektas turi teisę kreiptis į UAB “Cineskopė Rental” ir UAB „Cinevera“ su paklausimais, prašymais atšaukti duotus sutikimus dėl asmens duomenų tvarkymo, taip pat, pateikti prašymus dėl duomenų subjekto teisių įgyvendinimo ir/ar skundus dėl asmens duomenų tvarkymo.

UAB “Cineskopė Rental” ir UAB „Cinevera“ turi teisę bet kuriuo metu vienašališkai keisti šias asmens duomenų tvarkymo nuostatas, informuodamos duomenų subjektą apie pakeitimus paskelbiant interneto svetainėje www.cine.lt ne vėliau kaip prieš 20 (dvidešimt) kalendorinių dienų iki tokių pakeitimų įsigaliojimo.

  1. Sąvokos

1.1 Duomenų subjektas – fizinis asmuo, kurio asmens duomenis tvarko UAB “Cineskopė Rental” ir UAB „Cinevera“.

1.2 Asmens duomenys – bet kokia informacija apie fizinį asmenį, kurio tapatybė nustatyta arba kurio tapatybę galima nustatyti (duomenų subjektas); fizinis asmuo, kurio tapatybę galima nustatyti, yra asmuo, kurio tapatybę tiesiogiai arba netiesiogiai galima nustatyti, visų pirma pagal identifikatorių (vardą ir pavardę, asmens kodą, buvimo vietos duomenis ir/ar interneto identifikatorių) arba pagal vieną ar kelis to fizinio asmens fizinės, fiziologinės, genetinės, psichinės, ekonominės, kultūrinės ar socialinės tapatybės požymius;  

1.3 Asmens duomenų tvarkymas – bet kokia automatizuotomis arba neautomatizuotomis priemonėmis su asmens duomenimis ar asmens duomenų rinkiniais atliekama operacija ar operacijų seka: rinkimas, įrašymas, rūšiavimas, sisteminimas, saugojimas, adaptavimas ar keitimas, išgava, susipažinimas, naudojimas, atskleidimas persiunčiant, platinant ar kitu būdu sudarant galimybę jais naudotis, taip pat sugretinimas ar sujungimas su kitais duomenimis, apribojimas, ištrynimas arba sunaikinimas.

  1. Bendra informacija

2.1 Internetinė svetainė www.cine.lt priklauso UAB “Cineskopė Rental” ir UAB „Cinevera“, adresas korespondencijai – Manufaktūrų g. 16, Vilnius.

2.2 Nuostatose pateikiami pagrindiniai principai kaip UAB “Cineskopė Rental” ir UAB „Cinevera“ tvarko Asmens duomenis. Papildoma informacija apie Asmens duomenų tvarkymą nurodyta su UAB “Cineskopė Rental” ir UAB „Cinevera“ sudaromose sutartyse, taip pat UAB “Cineskopė Rental” ir UAB „Cinevera“ lokaliniuose teisės aktuose.

2.3 UAB “Cineskopė Rental” ir UAB „Cinevera“ įsipareigoja nepažeisti Asmens duomenų tvarkymo principų, nustatytų pagal galiojančius teisės aktus (Bendrąjį duomenų apsaugos reglamentą 2016/679, viešai skelbiamą adresu: http://eurlex.europa.eu/legalcontent/LT/TXT/PDF/?uri=OJ:L:2016:119:FULL&from=EN, toliau – Reglamentas; LR Asmens duomenų teisinės apsaugos įstatymą (naujausią redakciją) ir kt.) ir pritaikyti tinkamas technines ir organizacines priemones, skirtas apsaugoti tvarkomus Asmens duomenis nuo neteisėtos prieigos, atskleidimo, atsitiktinio praradimo, pakeitimo ar sunaikinimo ar kitokio neteisėto tvarkymo.

2.4 Asmens duomenų tvarkymui UAB “Cineskopė Rental” ir UAB „Cinevera“ gali pasitelkti duomenų tvarkytojus, kuriuos UAB “Cineskopė Rental” ir UAB „Cinevera“ įpareigoja laikytis teisėtų nurodymų ir galiojančių teisės aktų bei reikalauja įgyvendinti tinkamas Asmens duomenų saugumo priemones.   

2.5 Esant teisėtam asmens duomenų tvarkymo tikslui ir pagrindui, asmens duomenis UAB “Cineskopė Rental” ir UAB „Cinevera“ gali rinkti iš LR viešųjų valstybinių registrų bei teisėtai veiklą vykdančių privačių asmenų valdomų registrų.

2.6 www.cine.lt internetinė svetainė nenaudoja slapukų.

  1. Tvarkomų asmens duomenų kategorijos

Asmens tapatybės duomenys – vardas, pavardė, asmens kodas, gimimo data;

Kontaktiniai duomenys – adresas, telefono numeris, el. pašto adresas;

Duomenų subjekto teikiami duomenys – duomenys, kuriuos pateikia pats duomenų subjektas;

Profesiniai duomenys – duomenys apie išsilavinimą ir profesinę veiklą bei užimamas pareigas;

Finansiniai duomenys – duomenys apie darbo užmokestį;

4.1 Sutarčių vykdymas;

4.2 UAB “Cineskopė Rental” ir UAB „Cinevera“ teisėtas interesas;

4.3 UAB “Cineskopė Rental” ir UAB „Cinevera“ teisinės prievolės vykdymas;

4.4 Duomenų subjekto sutikimas.

 

  1. Asmens duomenų tvarkymo tikslai
  • Profesionalios kino (filmavimo ir apšvietimo) technikos nuoma;
  • Duomenų subjekto ir/ar įmonių interesų apsaugos;
  • Teisinių reikalavimų vykdymo bei užklausų, susijusių su asmens duomenų tvarkymu, administravimu;
  • Įmonių veiklos organizavimo ir vykdymo;
  • Įmonių dokumentų saugojimo;
  • Įmonių apskaitos ir mokestinių prievolių vykdymo;
  • Įmonių patalpų vaizdo stebėjimas įmonių turto ir asmenų saugumo užtikrinimui..
  1. Duomenų subjekto teisės

Kiekvieną iš žemiau išvardintų teisių duomenų subjektas gali įgyvendinti tik tinkamai save identifikavęs, t. y. pateikęs UAB “Cineskopė Rental” arba UAB „Cinevera“ atitinkamos formos raštišką (popierinį arba elektroninėmis priemonėmis pateikiamą) prašymą arba atvykęs į UAB “Cineskopė Rental” ir UAB „Cinevera“ buveinę bei pateikęs asmens tapatybę patvirtinančius įrodymus:

6.1 Sužinoti ar yra tvarkomi asmens duomenys ir jei taip – susipažinti su jais bei kita informacija: duomenų kilmės šaltiniais, duomenų tvarkymo pagrindais, tikslais ir gavėjais (per paskutinį vienerių metų laikotarpį), duomenų saugojimo tvarką ir kt.;

6.2 Reikalauti ištaisyti savo neteisingus, neišsamius ar netikslius asmens duomenis;

6.3 Nesutikti, kad būtų tvarkomi asmens duomenys, jeigu asmens duomenų tvarkymo pagrindas yra UAB “Cineskopė Rental” ir UAB „Cinevera“ teisėti interesai ir yra tinkamas teisinis pagrindas tokiam prašymui;  

6.4 Reikalauti ištrinti asmens duomenis, kurie yra tvarkomi neteisėtai ar nesąžiningai arba jei jie gauti pagal duomenų subjekto sutikimą ir jei duomenų subjektas atšaukia tokį sutikimą;

6.5 Apriboti asmens duomenų tvarkymą pagal galiojančius teisės aktus;

6.6 Gauti visų UAB “Cineskopė Rental” ir UAB „Cinevera“ elektroninėse duomenų bazėse tvarkomų jo asmens duomenų rinkinį (tvarkomą sutikimo arba sutarties vykdymo pagrindu), susistemintu, įprastai naudojamu ir kompiuteriu nuskaitomu elektroniniu formatu, taip pat, esant techninėms galimybėms, duomenų subjektas turi teisę prašyti UAB “Cineskopė Rental” ir UAB „Cinevera“ persiųsti šį rinkinį kitam duomenų valdytojui, nurodydamas tokio prašymo pagrindą ar motyvaciją (duomenų perkeliamumo teisė). Toks duomenų rinkinys subjektui gali būti įprastai pateikiamas PDF arba MS Excel elektroniniu formatu, taip pat, gali būti papildomai pateikiamas ir kaip popierinio atsakymo į duomenų subjekto užklausą priedas. Duomenų perkeliamumo teisė nėra susijusi su duomenų ištrynimu;   

6.7 Atšaukti savo sutikimą tvarkyti asmens duomenis;

6.8 Pateikti skundą dėl savo asmens duomenų tvarkymo Valstybinei duomenų apsaugos inspekcijai arba teismui, jei duomenų subjektas mano, kad jo asmens duomenys yra tvarkomi pažeidžiant jo teises ir teisėtus interesus.

UAB “Cineskopė Rental” ir UAB „Cinevera“, gavusi duomenų subjekto prašymą dėl savo teisių įgyvendinimo, duomenų subjektui pateikia atsakymą per 30 (trisdešimt) kalendorinių dienų nuo kreipimosi dienos. UAB “Cineskopė Rental” ir UAB „Cinevera“, motyvuotai pagrįsdama, gali pratęsti šį terminą iki 90 kalendorinių dienų, apie tai tinkamai informuodama duomenų subjektą.

  1. Asmens duomenų gavėjai

Esant teisėtam duomenų teikimo pagrindui ir tikslui, galimi asmens duomenų gavėjai:

7.1 Valstybinės įstaigos ir institucijos, kiti asmenys, vykdantys įstatymų jiems pavestas funkcijas (pvz., teismai, teisėsaugos institucijos, antstoliai, notarai, finansinių nusikaltimų tyrimo veiklą atliekančios institucijos);

7.2 UAB “Cineskopė Rental” ir UAB „Cinevera“ klientai;

7.3 Teisines, finansines, archyvavimo, pašto siuntimo, informacinių technologijų paslaugas teikiantys subjektai – UAB “Cineskopė Rental” ir UAB „Cinevera“ įgalioti duomenų tvarkytojai;

7.5 Kiti tretieji asmenys, turintys teisėtą interesą.

Visi duomenų gavėjai privalo turėti teisėtą interesą duomenų gavimui ir užtikrinti tinkamai pritaikytą organizacinių ir techninių priemonių duomenų apsaugos lygį. Taip pat, prieš gaudami asmens duomenis iš UAB “Cineskopė Rental” ir UAB „Cinevera“ raštiškai įsipareigoti laikytis reikalavimo neatskleisti asmens duomenų neįgaliotiems tretiesiems asmenims (konfidencialumo principas).

 

  1. Asmens duomenų perdavimas už Europos Sąjungos ribų

8.1 UAB “Cineskopė Rental” ir UAB „Cinevera“ asmens duomenis tvarko Europos Sąjungos ribose.

8.2 Asmens duomenys išimtiniais atvejais gali būti perduoti už Europos Sąjungos teritorijos, kai perdavimas yra būtinas sutarties sudarymui ir vykdymui arba duomenų subjektas davė sutikimą, taip pat, jeigu yra tenkinami reikalavimai dėl tinkamų apsaugos techninių ir organizacinių priemonių, patvirtintų pagal Bendrąjį duomenų apsaugos reglamentą 2016/679.

8.3 Šalis, nepriklausanti Europos Sąjungai, kurioje yra Asmens duomenų gavėjas, pagal Europos Sąjungos Komisijos patvirtintus kriterijus užtikrina pakankamo lygio asmens duomenų apsaugą.

  1. Asmens duomenų saugojimo laikotarpis
  • Asmens duomenys saugomi Reglamento ir Lietuvos Respublikos asmens duomenų apsaugos įstatymo nustatyta tvarka, vadovaujantis ribotumo principu – asmens duomenys saugomi tik tokį terminą ir tokia apimtimi, kiek Įmonei yra būtina, siekiant įgyvendinti Politikoje numatytus teisėtus duomenų tvarkymo tikslus. Nelikus teisėto tikslo asmens duomenų tvarkymui, asmens duomenys yra sunaikinami. Detalesni konkrečių asmens duomenų saugojimo terminai pateikiami Įmonės asmens duomenų apsaugos politikoje.
  • Įmonės tvarkomiems asmens duomenims taip pat taikomi 2011-03-09 Lietuvos Vyriausiojo archyvaro įsakymu dėl bendrųjų dokumentų saugojimo terminų Nr. V-100 ir kitų teisės aktų nustatyti duomenų saugojimo terminai.
  1. Profiliavimas ir automatizuoti sprendimai

10.1 Profiliavimas – bet kokios formos automatizuotas asmens duomenų tvarkymas, kai asmens duomenys naudojami siekiant įvertinti tam tikrus su fiziniu asmeniu susijusius asmeninius aspektus, visų pirma siekiant išanalizuoti ar numatyti aspektus, susijusius su to fizinio asmens darbo rezultatais, ekonomine situacija, sveikatos būkle, asmeniniais pomėgiais, interesais, patikimumu, elgesiu, buvimo vieta arba judėjimu ir tai turi tiesioginių teisinių ar finansinių pasekmių tam fiziniam asmeniui.

10.2 UAB “Cineskopė Rental” ir UAB „Cinevera ” nepriima jokių išimtinai automatizuotų sprendimų, taip pat, nevykdo profiliavimo. Visuose įmonės sprendimų priėmimo procesuose dalyvauja žmogus.  

  1. Taikomos organizacinės ir techninės priemonės duomenų saugumui

Atsižvelgiant į Reglamento reikalavimus, UAB “Cineskopė Rental” ir UAB „Cinevera“ yra įgyvendinusios šias organizacines ir technines priemones, siekiant apsaugoti tvarkomus asmens duomenis ir iki minimumo sumažinti riziką tokių duomenų praradimui, nutekėjimui ar kitokiam duomenų tvarkymo pažeidimui:

11.1 vidinis ir išorinis duomenų šifravimas;

11.2 techninių-programinių priemonių, leidžiančių atkurti sąlygas ir galimybes naudotis saugomais asmens duomenimis fizinio ar techninio pažeidimo atveju, naudojimas;

11.3 darbuotojų prieigos prie tvarkomų asmens duomenų fizinė bei elektroninė kontrolė;

11.4 įvairios patekimo į įmonės patalpas apsauginės priemonės.

  1. Vaizdo stebėjimas Įmonės patalpose

12.1 Vaizdo stebėjimas – vaizdo duomenų, susijusių su fiziniu asmeniu, tvarkymas naudojant automatines vaizdo stebėjimo kameras.

12.2 Įmonės vykdo vaizdo stebėjimą savo vidaus patalpose (biure ir sandėlyje) bei vidiniame kieme adresu Manufaktūrų g. 16, Vilnius.

12.3 Vaizdo duomenų tvarkymo tikslas – Įmonių turto bei asmenų saugumo užtikrinimas.

12.4 Vaizdo duomenų tvarkymo pagrindas – Reglamento 6 straipsnio 1 dalies f punktas (teisėtas interesas). Pagrįsti šiam tikslui Įmonės yra atlikusios interesų balanso testą bei Poveikio Duomenų apsaugai vertinimą.

12.5 Nurodytų teritorijų vaizdo stebėjimas yra nenutrūkstamas.  Garso duomenys nėra fiksuojami ir renkami.

12.6 Vaizdo kameros montuojamos taip, kad vaizdo stebėjimas būtų vykdomas ne didesnėje patalpų dalyje, negu tai yra būtina. Į vaizdo kamerų stebėjimo lauką negali patekti gyvenamosios patalpos ir/arba jai priklausanti privati teritorija (arba toks plotas sumažinamas iki fiziškai mažiausiai įmanomo) arba įėjimas į ją, taip pat patalpos ar teritorija, kurioje Duomenų subjektas tikisi absoliučios duomenų apsaugos, pavyzdžiui, persirengimo, poilsio, vonios, tualeto kambariai.

12.7 Vaizdo stebėjimo duomenys nenaudojami kitiems tikslams, nesusijusiems su 12.3 punkte apibrėžtu tikslu.

12.8 Vaizdo stebėjimo duomenys atskirame šifruotame kietajame diske saugomi ne ilgiau nei 7 dienas, po to yra automatiškai ištrinami.

12.9 Atsižvelgiant į Reglamento 18 ir 20 str. nuostatas, Duomenų subjektas turi šias teises:

12.10. žinoti (būti informuotas) apie savo duomenų tvarkymą;

12.11. susipažinti su savo duomenimis ir kaip jie yra tvarkomi;

12.12. nesutikti, kad būtų tvarkomi jo asmens duomenys;

12.13. reikalauti ištrinti asmens duomenis, jei tvarkomi pertekliniai asmens duomenys ar yra kitas Reglamente nustatytas pagrindas;

12.14. reikalauti apriboti duomenų tvarkymą, jei yra Reglamente nustatytas pagrindas.

12.15. Duomenų subjekto teisė žinoti apie savo asmens duomenų tvarkymą įgyvendinama taip:

12.16 iškabinant informacines lenteles tvirtinamas prieš patenkant į patalpą ar teritoriją, kurioje vykdomas vaizdo stebėjimas;

12.17. informacinėje lentelėje nurodant, kad yra vykdomas vaizdo stebėjimas, vaizdo stebėjimo tikslą, Duomenų valdytojo kontaktinė informacija.

12.18. Duomenų subjekto teisė susipažinti su savo vaizdo duomenimis įgyvendinama šia tvarka:

12.19 Duomenų subjektas, norėdamas susipažinti su savo vaizdo duomenimis, pateikia prašymą raštu, valstybine kalba elektroniniu paštu adresu ingrida@cineskope.lt, įteikiant prašymą asmeniškai arba paštu adresu Manufaktūrų g. 16, Vilnius.. Duomenų subjektas (jeigu jis nėra Įmonių darbuotojas) su savo prašymu Įmonėms taip pat pateikia jo asmens tapatybę patvirtinantį dokumentą arba teisės aktų nustatyta tvarka ar elektroninių ryšių priemonėmis, kurios leidžia tinkamai identifikuoti asmenį, patvirtina savo asmens tapatybę. Kai dėl informacijos apie asmenį kreipiasi jo atstovas, jis turi pateikti atstovavimą patvirtinantį dokumentą ir savo asmens tapatybę patvirtinantį dokumentą;

12.20. gavęs Duomenų subjekto prašymą susipažinti su vaizdo duomenimis, bet kurios iš Įmonių vadovas ar jo įgaliotas asmuo įvertina ir priima sprendimą leisti ar neleisti susipažinti su vaizdo duomenimis. Informacija ar su Duomenų subjektu susiję vaizdo duomenys yra tvarkomi ir duomenų subjekto prašomi duomenys pateikiami ne vėliau kaip ne vėliau kaip per vieną mėnesį nuo prašymo gavimo. Duomenų subjekto prašymu tokie duomenys turi būti pateikiami raštu.

12.21. įgyvendinant Duomenų subjekto teisę susipažinti su savo vaizdo duomenimis užtikrinama trečiųjų asmenų teisė į privatų gyvenimą, t. y. Duomenų subjektui susipažįstant su vaizdo įrašu, jeigu vaizdo įraše matomi kiti asmenys, kurių tapatybė gali būti nustatyta, ar kita informacija, kuri gali pažeisti trečiųjų asmenų privatumą, šie vaizdai turi būti retušuoti ar kitais būdais panaikinta galimybė identifikuoti trečiuosius asmenis (jeigu tai techniškai įmanoma arba nesukuria neproporcingos naštos Įmonei).

12.22. Duomenų subjekto teisė nesutikti su vaizdo duomenų tvarkymu, teisė reikalauti ištrinti asmens duomenis, teisė reikalauti apriboti duomenų tvarkymą įgyvendinama šia tvarka:

12.23. siekdamas įgyvendinti aukščiau nurodytas teises, Duomenų subjektas pateikia prašymą raštu, valstybine kalba elektroniniu paštu adresu ingrida@cineskope.lt, įteikiant prašymą asmeniškai arba paštu adresu Manufaktūrų g. 16, Vilnius. Įmonė, gavusi tokį prašymą, jį įvertina ir priima sprendimą nutraukti asmens duomenų tvarkymą, ištrinti ar apriboti atitinkamų asmens duomenų tvarkymą, išskyrus atvejus, kai duomenys tvarkomi dėl teisėtų priežasčių, kurios yra viršesnės už duomenų subjekto interesus, teises ir laisves, arba siekiant pareikšti, vykdyti ar apginti teisinius reikalavimus ar dėl to būtų padaryta žala pačiai Įmonei.

12.24. Jeigu Duomenų subjekto prašymai yra akivaizdžiai nepagrįsti ar neproporcingi, visų pirma dėl jų pasikartojančio turinio, Įmonė gali:

12.25. imti pagrįstą mokestį, atsižvelgdamas į informacijos teikimo ar veiksmų, kurių prašoma, administracines išlaidas;

12.26. gali atsisakyti imtis veiksmų pagal prašymą

2.3 UAB “Cineskopė Rental” and UAB “Cinevera” undertake not to violate the principles of personal data processing established in accordance with current legal acts (General Data Protection Regulation 2016/679, publicly available at: http://eurlex.europa.eu/legalcontent/LT/ TXT/PDF/?uri=OJ:L:2016:119:FULL&from=EN, hereinafter – the Regulation; the Law on the Legal Protection of Personal Data of the Republic of Lithuania (the latest version), etc.) and apply appropriate technical and organizational measures to protect the processed Personal Data against unauthorized access, disclosure, accidental loss, alteration or destruction or other unauthorized processing.

2.4 UAB “Cineskopė Rental” and UAB “Cinevera” may use data processors for the processing of personal data, which UAB “Cineskopė Rental” and UAB “Cinevera” oblige to comply with legal instructions and valid legal acts and require the implementation of appropriate personal data security measures.

2.5 If there is a legal purpose and basis for processing personal data, UAB “Cineskopė Rental” and UAB “Cinevera” may collect personal data from the public state registers of the Republic of Lithuania and registers managed by legally operating private individuals.

2.6 The www.cine.lt website does not use cookies.

  1. Purposes of processing personal data

5.1 Rental of professional cinema (filming and lighting) equipment;

5.2 Protection of the interests of the data subject and/or companies;

5.3 Administration of the fulfillment of legal requirements and requests related to the processing of personal data;

5.4 Organization and execution of company activities;

5.5 Storage of company documents;

5.6 Accounting and fulfillment of tax obligations of companies;

5.7 Video surveillance of company premises to ensure the safety of company property and personel.

  1. Rights of the data subject

Each of the rights listed below can be exercised by the data subject only after properly identifying himself, i.e. after submitting a written (paper or electronic) application to UAB “Cineskopė Rental” or UAB “Cinevera” in the appropriate form or arriving at the headquarters of UAB “Cineskopė Rental” and UAB “Cinevera” and presenting proof of personal identity:

6.1 To find out whether personal data is being processed and, if so, to get acquainted with it and other information: sources of data origin, grounds of data processing, purposes and recipients (within the last one-year period), data storage procedure, etc.;

6.2 Demand correction of your incorrect, incomplete or inaccurate personal data;

6.3 Do not consent to the processing of personal data, if the basis for the processing of personal data is the legitimate interests of UAB “Cineskopė Rental” and UAB “Cinevera” and there is a suitable legal basis for such a request;

6.4 Demand the deletion of personal data that is processed illegally or dishonestly or if it is obtained based on the data subject’s consent and if the data subject withdraws such consent;

6.5 Limit the processing of personal data in accordance with the applicable legislation;

6.6 Receive a set of all his personal data processed in the electronic databases of UAB “Cineskopė Rental” and UAB “Cinevera” (processed on the basis of consent or performance of the contract), in a systematized, commonly used and computer-readable electronic format, also, if technical possibilities exist, the data subject must the right to request UAB “Cineskopė Rental” and UAB “Cinevera” to forward this set to another data controller, specifying the basis or motivation for such a request (right to data portability). Such a set of data can be normally provided to the subject in PDF or MS Excel electronic format, and can also be additionally provided as an attachment to the paper response to the data subject’s request. The right to data portability does not relate to data deletion;

6.7 Revoke your consent to process personal data;

6.8 Submit a complaint regarding the processing of personal data to the State Data Protection Inspection or to a court, if the data subject believes that his personal data is being processed in violation of his rights and legitimate interests.

UAB “Cineskopė Rental” and UAB “Cinevera”, upon receiving the data subject’s request for the exercise of their rights, provide the data subject with an answer within 30 (thirty) calendar days from the date of the request. UAB “Cineskopė Rental” and UAB “Cinevera”, with reasoned reasons, may extend this term up to 90 calendar days, duly informing the data subject.

  1. Recipients of personal data

With the legal basis and purpose of data provision, possible recipients of personal data:

7.1 State institutions, other legal entities performing the functions assigned to them by law (e.g. courts, law enforcement institutions, bailiffs, notaries, institutions performing financial crime investigation activities);

7.2 Customers of UAB “Cineskopė Rental” and UAB “Cinevera”;

7.3 Entities providing legal, financial, archiving, mailing, information technology services – UAB “Cineskopė Rental” and UAB “Cinevera” authorized data processors;

7.5 Other third parties with a legitimate interest.

All data recipients must have a legitimate interest in receiving data and ensure a properly adapted organizational and technical data protection level. Also, before receiving personal data from UAB “Cineskopė Rental” and UAB “Cinevera”, they must sign a written document to comply with the requirement not to disclose personal data to unauthorized third parties (principle of confidentiality).

  1. Transfer of personal data outside the European Union

8.1 UAB “Cineskopė Rental” and UAB “Cinevera” process personal data within the borders of the European Union.

8.2 In exceptional cases, personal data may be transferred outside the territory of the European Union, when the transfer is necessary for the conclusion and performance of a contract or the data subject has given consent, as well as if the requirements for appropriate technical and organizational protection measures approved in accordance with the General Data Protection Regulation 2016/ 679.

8.3 The country outside the European Union, where the recipient of Personal Data is located, ensures a sufficient level of personal data protection in accordance with the criteria approved by the Commission of the European Union.

  1. Personal data storage period

9.1 Personal data is stored in accordance with the procedure established by the Regulation and the Personal Data Protection Law of the Republic of Lithuania, based on the principle of limitation – personal data is stored only for such a period and to such an extent as is necessary for the Company in order to implement the legitimate purposes of data processing provided for in the Policy. If there is no legitimate purpose for the processing of personal data, personal data is destroyed. More detailed storage terms for specific personal data are provided in the Company’s personal data protection policy.

9.2 The personal data processed by the company are also subject to the order of the Chief Archivist of Lithuania dated 03/09/2011 on general document storage terms No. Data storage terms set by V-100 and other legal acts.

  1. Profiling and automated solutions

10.1 Profiling – any form of automated processing of personal data, when personal data is used to evaluate certain personal aspects related to a natural person, in particular to analyze or predict aspects related to the work results, economic situation, state of health, personal interests of that natural person  interests, credibility, conduct, location or movement and that has direct legal or financial consequences for that natural person.

10.2 UAB “Cineskopė Rental” and UAB “Cinevera” do not make any exclusively automated decisions, nor do they perform profiling. A person is involved in all decision-making processes of the company.

  1. Applied organizational and technical measures for data security

Taking into account the requirements of the Regulation, UAB “Cineskopė Rental” and UAB “Cinevera” have implemented the following organizational and technical measures in order to protect processed personal data and minimize the risk of loss, leakage or other data processing violations:

11.1 internal and external data encryption;

11.2 the use of technical and software tools that allow restoring the conditions to use protected personal data in the event of a physical or technical breach;

11.3 physical and electronic control of employees’ access to processed personal data;

11.4 various security measures for access to company premises (alarm system, video surveillance, personal magnetic cards for entrance).

  1. Video surveillance in the Company’s premises

12.1 Video surveillance – processing of video data related to a natural person using automatic video surveillance cameras.

12.2 Companies carry out video surveillance in their internal premises (office and warehouse) and in the courtyard at Manufaktūrų str. 16, Vilnius.

12.3 The purpose of video data processing is to ensure the security of company property and individuals.

12.4 The basis for video data processing is Article 6, Paragraph 1, Clause f of the Regulation (legitimate interest). For this purpose, the companies have performed a balance of interests test and an assessment of the impact on data protection.

12.5 Video surveillance of the specified areas is continuous. Audio data is not recorded or collected.

12.6 Video cameras are installed in such a way that video monitoring is carried out in no larger part of the premises than is necessary. The surveillance field of the video cameras cannot enter the residential premises and/or the private territory belonging to it (or such an area is reduced to the least physically possible) or the entrance to it, as well as premises or territory where the Data Subject expects absolute data protection, for example, changing clothes, resting areas, bathrooms, toilet rooms.

12.7 Video surveillance data is not used for purposes other than the purpose defined in clause 12.3.

12.8 Video surveillance data is stored on a separate encrypted hard drive for no longer than 7 days, after which it is automatically deleted.

12.9 Considering Articles 18 and 20 of the Regulation. provisions, the Data Subject has the following rights:

12.10. to know (be informed) about the processing of your data;

12.11. to familiarize yourself with your data and how it is handled;

12.12. do not consent to the processing of his personal data;

12.13. demand deletion of personal data if redundant personal data is processed or there is another basis established by the Regulation;

12.14. to demand restriction of data processing if there is a basis established by the Regulation.

12.15. The data subject’s right to know about the processing of his personal data is implemented as follows:

12.16 before entering the offices or warehouse where video surveillance is carried out, there are information boards displayed;

12.17. the information board indicates the fact that video surveillance is being carried out, also the purpose of video surveillance, the contact information of the Data Controller.

12.18. The data subject’s right to access his video data is implemented in the following order:

12.19 The data subject, wishing to get acquainted with his video data, submits a written request in the national language by e-mail to ingrida@cineskope.lt, delivering the request in person or by mail to Manufaktūrų st. 16, Vilnius.. The data subject (if he is not an employee of the Companies) with his request also submits a document confirming his personal identity to the Companies or confirms his personal identity in accordance with the procedure established by legal acts or electronic means of communication that allow proper identification of the person. When a person’s representative applies for information about a person, he must submit a document confirming the representation and a document confirming his identity;

12.20. after receiving the Data subject’s request for access to video data, the manager of any of the Companies or his authorized person evaluates and makes a decision to allow or deny access to video data. Information or image data related to the Data Subject is processed and the data requested by the Data Subject is provided no later than within one month of receiving the request. At the request of the data subject, such data must be provided in writing.

12.21. by implementing the Data Subject’s right to access his image data companies also ensure the right of third parties to private life, i.e. i.e. When the data subject becomes familiar with the video, if the video shows other identifiable persons or other information that may violate the privacy of third parties, these images must be retouched or in other ways eliminate the possibility of identifying third parties (if this is technically possible or does not create a disproportionate burden for the Company).

12.22. The right of the data subject to object to the processing of image data, the right to demand deletion of personal data, the right to demand restriction of data processing is implemented in the following order:

12.23. in order to exercise the above-mentioned rights, the Data Subject submits a request in writing, in the national language, by e-mail to ingrida@cineskope.lt, delivering the request in person or by post to Manufaktūrų st. 16, Vilnius. Upon receiving such a request, the company evaluates it and makes a decision to terminate the processing of personal data, to delete or limit the processing of the relevant personal data, except in cases where the data is processed for legitimate reasons that override the interests, rights and freedoms of the data subject, or in order to declare, to enforce or defend legal claims or as a result would cause damage to the Company itself.

12.24. If the Data Subject’s requests are clearly unreasonable or disproportionate, primarily due to their repetitive content, the Company may:

12.25. charge a reasonable fee, taking into account the administrative costs of providing the information or actions requested;

12.26. may refuse to act on the request.
